This bill would require any solar developer seeking to build a solar facility on farmland greater than 20 acres to apply for a certificate from the Public Service Commission. We have concerns that putting all solar projects through the PSC, even some as small as 3 MW, will impede private property rights decisions, limit local government authority, and slow the development of clean energy projects across the state. Currently, state law requires any power generation over 75MW, regardless of the type of power generation, to recieve a certificate from the Public Service Commission and provides an even playing-field.
