This bill is very similar to Senator Davis’ Data Center Development Act except that it requires all data centers to apply for a certificate at the Public Service Commission rather than with the Department of Environmental Services. While this bill still requires transparency around water use, directs the Public Service Commission (PSC) to ensure data centers bear the full cost to serve their major power requirements, and includes other ‘good neighbor’ safeguards around concerns like noise, vibration, and light, we have the same concerns as Senator Davis’ bill along with additional concerns that this bill could allow the Public Service Commission to overturn local zoning and siting decisions for new data centers. We will continue monitoring this bill to ensure that data center growth does not come at the expense of the environment and local communities.
